Brian Jenkins is a part of the Commercial Litigation practice group. He is a seasoned practitioner with many years of trial and tribunal experience and has appeared at all levels of the Ontario Courts. For a number of years, Brian served as a Judge in small claims court, which affords his clients very useful perspective in strategy development.
Brian represents clients in matters extending from individual business disputes to complex contested matters, including fraud claims, share valuation proceedings, estate litigation, contractual disputes and debt collection, including, security or mortgage enforcement. He has developed particular expertise in resolving shareholder disputes and related issues in privately held companies and partnerships.
Brian acts on behalf of large and small private companies, family businesses, professionals, financial institutions, and not for profit organizations. He also acts on several counsels for condominium corporations, managers and unit owners in mediation, arbitration and court proceedings pursuant to the Condominium Act, 1998. In addition to providing counsel on such cases, he acts as a management resource to boards of directors and property managers on all areas of condominium law and administration.
In the area of estate litigation Brian represents individuals and family groups in matters including duties of Executors and Trustees and rights of beneficiaries, dependant adult applications, settling a variety of family disputes including undue influence claims, will challenges, breach of trust actions, interpretation and enforceability of wills, the appointment or removal of trustees, passing of accounts in trusts and estates and dependant relief applications.
